This website and all consulting and coaching products, services, or information of any kind shared or offered by or through MoonGate Feng Shui, (or "Living Light") or shared by any representative of MoonGate Feng Shui at any time, are meant to support your own efforts to optimize your personal wellbeing. MoonGate Feng Shui consulting and coaching products, services and programs (known hereafter as ‘the work’) are meant to assist and encourage changes in your mindset & behaviors which can contribute to achieving your self-motivated goals.  

By using this website and any product or service from MoonGate Feng Shui or from any representative thereof, you confirm that you have thoroughly read, understand, and agree to each of the following statements:

 

Coaching Disclaimer & Locale

• I understand that the coaching products and services I will be receiving are not intended to diagnose, treat or cure any mental health or medical condition(s). I also understand that MoonGate Feng Shui consultants and Living Light coaches are not mental health counselors or medical professionals.

• I understand that Feng Shui and declutter coaching is not a substitute for clinical counseling, psychotherapy, psychoanalysis, substance abuse treatment, mental health care, or medical care of any kind and I will not use it in place of any form of mental or physical therapy or medical care.

• I understand that coaching is, at present, an unregulated industry and that our coaches are not licensed by the State of California or any other state.  I also understand that for all legal purposes, the services provided by MoonGate Feng Shui or any representative thereof will be considered to be provided in the State of California.

 

Participant Confidentiality

• I understand that MoonGate Feng Shui and representatives will protect my information as confidential unless I state otherwise in writing. I further understand that if I report or mention child or elder abuse or neglect, or threaten to harm myself or someone else, that or representatives may take any actions deemed necessary for the protection of myself or anyone who may be under threat of harm and that my confidentiality is limited in this capacity.  Furthermore, if MoonGate Feng Shui or any representative is ordered by a court to provide information or to testify, the order will be fulfilled to the extent the law requires.

• I understand that the use of technology is not always secure and I accept the risks of confidentiality in the use of email, text, phone, web, video conference, and other technology.

• As a member any MoonGate Feng Shui program, I agree to protect the information shared by all other group members as confidential and to not disclose to anyone outside that particular group any information that may serve to identify another group member. This includes, but is not limited to, names, physical descriptions, biological information, and specifics to the content of interactions with other group members.

 

Protecting Intellectual Property

• I understand that any information, techniques, documents, or electronic communications I receive from MoonGate Feng Shui are the intellectual property of MoonGate Feng Shui which has been developed through substantial effort, research, time, and expense and are for my personal use alone.  I agree to protect and to refrain from sharing, disclosing, copying, selling, or offering for sale any and all such intellectual property with or to any other person or persons.

 

No Warranty

• I understand that I am solely responsible for achieving any outcome I pursue with support from MoonGate Feng Shui and its representatives, and that MoonGate Feng Shui and its representatives cannot guarantee any outcome of any kind through use of its coaching products or services.  This includes but is not limited to outcomes in the areas of health, fitness, psychological or emotional state or wellbeing, business, finance, or relationships.

• I understand that MoonGate Feng Shui products and services are provided “as is” without warranty of any kind, either expressed or implied, including without limitation any warranty for information services, coaching, uninterrupted access, or products and services provided through or in connection with the service.

 

Acknowledgement & Assumption of Risk

• I acknowledge and fully understand that ‘the work’ can be strenuous and that following the guidance of MoonGate Feng Shui products, services, or representatives may require emotional, physical, and mental efforts, behavioral adjustments and experimentation which may cause physical, mental or emotional stress or injury.  I am using these coaching services and undertake any guidance entirely at my own risk and singular responsibility. Any actions or lack of actions I take in relation to MoonGate Feng Shui products or services are taken of my own free will and I am wholly and singularly liable and responsible for any outcome, non outcome or consequence of such actions or non-actions.

• I knowingly and freely assume all risks, both known and unknown, even those arising from the negligent acts or omission of others and assume full responsibility for my own participation and all aspects of my well-being in choosing to follow or disregard any coaching suggestions or guidance provided by MoonGate Feng Shui or any representative thereof.

 

Release & Waiver of Liability

• I accept personal responsibility for the damages following any physical, psychological or emotional injury, including permanent disability or death, and including those resulting from the negligence of MoonGate Feng Shui or its officers, servants, agents, employees and volunteers (hereinafter referred to as “releasees”).

• I further hereby agree to indemnify and save and hold harmless the releasees, from any loss, liability, damage or costs they may incur due to my participation in this Activity, whether caused by the negligence of any or all of the releasees, or otherwise.

• I hereby release, waive, covenant not to sue, acquit and forever discharge MoonGate Feng Shui and its officers, employees, volunteers, servants, agents, successors, assigns, executors, heirs and employees from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or relating to any loss, damage or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the releasees, or otherwise resulting from the coaching relationship contemplated by this agreement. I further declare and represent that no promise, inducement or agreement not expressed in this agreement has been made to me to sign this agreement. This agreement shall bind my heirs, executors, personal representatives, successors, assigns, and agents.
